These Terms and Conditions govern all services provided by JJA Wright Care Consultancy (“we”, “us”, “our”). By commissioning our services, the client (“you”, “your”) agrees to these Terms and Conditions.

We provides independent social work services and family support services delivered by independent social workers and trained family support practitioners. All advice, assessments, and professional opinions offered by our team are entirely independent.

1. Nature of services

1.1. Independent services

  • All services are delivered by independent social workers registered with Social Work England and trained family support practitioners.
  • Our practitioners operate solely in an independent capacity, free from influence or direction from any party involved in the case.

1.2. Scope of work
We provide:

  • Independent social work assessments
  • Expert opinion and analysis
  • Family support interventions
  • Reports for public and private law proceedings
  • Reports for supervised contact based on what is observed and heard within the session only.

1.3. No case management or decision‑making role

  • We do not hold statutory authority.
  • We do not make decisions regarding care planning, safeguarding actions, or legal outcomes.
  • We do not case manage, coordinate services, or act as the lead professional for any child or family.
  • Responsibility for all decisions remains with the commissioning agency, local authority, legal representatives, or court.

Our role remains purely Independent.

2. Commissioning and instructions

  • Instructions must be provided by the person commissioning the service, and these instructions will be shared with the other party before the service begins.
  • Any changes to the agreed scope of work must be communicated and confirmed by the person commissioning the service, and such changes may affect timescales.
  • We reserve the right to decline instructions that fall outside our professional remit or competence.

3. Fees and payment

Fees will be outlined in a written quotation or service agreement prior to commencement.

4. Confidentiality and data protection

  • We adhere to all relevant data protection legislation, including the UK GDPR and Data Protection Act 2018.
  • Information will only be shared where necessary for the completion of the commissioned work or where legally required. Reports are provided to the commissioner only unless where there are safeguarding concerns raised or required by Law. This will be assessed by us to determine what information can be shared in line with the Law.
  • All records are stored securely and retained in accordance with statutory requirements.

5. Professional standards

  • All independent social workers are registered with Social Work England.
  • All family support practitioners work within their professional competencies and under the Consultancy’s quality assurance framework. They are also independent in the services provided.
  • We maintain professional indemnity and public liability insurance.

6. Reports and professional opinions

  • Reports are based on the information available at the time of assessment or observation.
  • We cannot be held responsible for omissions or inaccuracies resulting from withheld, incomplete, or inaccurate information provided by third parties.
  • Our professional opinions are independent and may not align with the views of any party involved in the case. We remain Independent at all times.

7. Limitations of liability

  • We are not liable for decisions made by clients, courts, or other agencies based on our reports or advice.
  • We do not accept responsibility for actions taken by third parties following the completion of our work.

8. Cancellation and termination

  • Either party may terminate the agreement with written notice.
  • Fees may still apply for work completed up to the date of termination.
  • Short‑notice cancellations may incur charges as outlined in the service agreement.
  • We reserve the right to terminate the contract at any point, and this will be provided in writing to the person commissioning the service.

9. Complaints

  • Complaints should be submitted in writing.
  • We will acknowledge and investigate complaints in line with our internal complaints procedure.

10. Governing law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
